Class C Misdemeanor Violations Filed Against a Corporate Defendant or Association
Pursuant to Texas Code of Criminal Procedure, Chapter 17A, corporate defendants/associations are to be summoned by a peace officer. The court is required to ensure a summons is personally delivered to the parties outlined in the chapter referenced above before the matter is docketed for a mandatory appearance.
Other important information about cases filed against a corporate defendant:
Once summons is served, a court date is set, and the required parties are noticed, the corporation’s attorney must file a letter of representation and appear as scheduled on the notice; these cases are mandatory appearances.
The attorney of record shall file a motion for continuance or any other request regarding the corporate defendant matter.
Violations filed against a corporation or association cannot be paid online or processed by a clerk until the matter is heard by a judge and a sentence has been imposed.
