NOTICE OF COMPLAINT
March 24, 2023
ICMS #: 2023-0231
On March 15, 2023, the OPO received a phone complaint.
The complainant alleges: She is originally from
She was in a car with two
.
other females and two dudes. Officers pulled their car over and found probable cause to
search the vehicle. One of the officers pulled her and the two other females from the car
and proceeded to search them. The male officer began to search the complainant by lifting
and touching her breast. She told the officer that he should call a female officer to do the
search. The complainant alleges the officer told her if he used the back of his hand, it was
ok, which was totally not ok because she felt violated. The officer knew nothing about her.
The complainant is an MHMR patient and could have flipped out on him at any time. Just
because she is young and 21 the officer thought she did not know her rights. The
complainant got back in the car and was on her phone when the officer told her she had to
get off her phone. She told him she had a right to be on her phone. The officer later told
the complainant that she was right, and she did have the right to be on her phone. He then
told her that he almost got ambushed when he was on another call because the person called
someone to come and kill him. She explained to the officer that the situation was different
because she was only calling her mother to let her know that they had just gotten pulled
over by the police. The complainant's main complaint is that she never heard it was ok for
a male officer to search a female, even if he used the back of his hands.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
