Authorize the City Manager to negotiate and execute an agreement with Brushy Creek Municipal Utility District ("Brushy Creek") for the provision of out-of-district water and wastewater service to approximately 10 acres located adjacent to Brushy Creek's southern boundary. Brushy Creek and the landowners will be responsible for the necessary infrastructure improvements. No City funding is required for this agreement. Recommended by the Water and Wastewater Commission.

Authorize negotiation of a lease and related documents and agreements with GE Commercial Aviation Services, LLC for up to 40 acres of land at Austin-Bergstrom International Airport for the construction, operation and maintenance of a low cost "no-frills" airport terminal, and associated uses including, but not limited to, car parking, rental car facilities, and ground transportation staging for a term not to exceed thirty years from the date of beneficial occupancy of the new terminal at a rental of not less than $0.22 per square foot plus a percentage of net revenue. Recommended by the Austin Airport Advisory Commission.

Approve an ordinance authorizing acceptance of $2,845 in grant funds from the TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS, Austin, TX; and amending the Fiscal Year 2006-2007 Health and Human Services Department Operating Budget Special Revenue Fund of Ordinance No. 20060911-001 to appropriate $2,845 for a total grant amount of $805,977 for the delivery of basic needs and other self-sufficiency resources for low-income residents. Funding is available from the Texas Department of Housing and Community Affairs, Community Services Block Grant program. The grant period is January 1, 2006 through December 31, 2007. No City match is required.

Adopt a resolution approving recommendations for transportation improvement projects funded by the 2000 Transportation Bond Program. Recommended by the Urban Transportation Commission.
Resolution No. 20070823-020 was approved with the following amendments on Council Member McCracken's motion, Council Member Kim's second on a 7-0 vote. The amendment was to delete the Nueces Street and Second Street Green Water Treatment street extensions, making such funds available for utilization for the Brazos Street project. Council Member Leffingwell noted the remainder of the staff and the Urban Transportation Commission recommendations remain in the resolution.

Motion to grant the appeal received 3 votes, and 1 vote against the appeal from the Building and Fire Code Board of Appeals. In order to overturn a Building Official decision, 4 votes in favor are required.
The public hearing was closed and the appeal was approved on Council Member McCracken's motion, Council Member Martinez' second on a 4-3 vote. Those voting aye were: Mayor Wynn and Council Members Cole, Martinez and McCracken. Those voting nay were: Mayor Pro Tem Dunkerley and Council Members Kim and Leffingwell.
