Complaint: Complainant,
alleges APD racially profiled him and refused to
let the complainant return to class until his identify was confirmed. The complainant requested
his complaint be formally investigated.
This notice of formal complaint is a request for Internal Affairs to conduct an investigation in
order to determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
Recommended Administrative Policies to Review (to include but not limited to):
328.3.1 REASON FOR DETENTION
Officers detaining a person shall be prepared to articulate sufficient reason for a lawful detention,
independent of the individual's membership in a protected class. To the extent that written
documentation would otherwise be completed (e.g., arrest report, field observation (FO) card),
the involved officer should include those facts giving rise to the authority for the detention, as
applicable. Nothing in this order shall require any officer to document a contact that would not
otherwise require reporting
Recommended Classification: The OPO is permitted to make a preliminary recommendation
on the classification of administrative cases.
The OPO recommends that this allegation receive a B classification.
