On June 22, 2022, the OPO received a phone complaint.
The complainant alleges: APD pulled her father over for a DWI because his vehicle was
swerving. Her father explained to the officer that he was coming from home, heading to
work, and he was swerving to miss potholes in the road. APD told him that he was under
the influence of alcohol and gave him a sobriety test. He did not pass the eye test because
he moved his head, and he did not pass the walking test because her 69-year-old father
could not walk straight because of the gravel that was on the road. The officer called for
backup SO there was a total of 4 officers on the scene for her 69-year-old father. Her father
blew a 0 for the breathalyzer test and APD still took him into custody. Her father requested
to take a blood test which also showed he was not drunk. APD took him downtown anyway,
booked him, fingerprinted him, and put him in a cell. Hours later another officer took her
father out of the cell and gave him the same test as before and then apologized to him and
told him he did not smell like alcohol, and he should have never been taken to jail and that
he was going to have the officer take him to get his car out of the pound. She feels like her
father was being profiled and the entire incident was a violation of his rights.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
