On September 22, 2022, the OPO received a phone complaint.
The complainant alleges: He left the club and was waiting for his Uber when an officer
came up to him. The next thing he knows, he's pepper sprayed and the officer is saying to
stop resisting arrest. The complainant is trying to wipe his eyes on his shirt and realizes the
officer is still trying to restrain him. He broke his arm. He told the officer he couldn't feel
his arm. He asked if he could call his emergency contact and asked for the officer's name
& badge # but the officer stayed quiet. The complainant was released from jail some hours
later. The police report said an anonymous call was made, saying he was lying down on
the side of the road. That is not what happened. He is now missing work and having other
difficulties because of his broken arm.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
