On September 29, 2022, the OPO received an online complaint.
The complainant alleges: My name is
and represent my client
who was arrested in APD report GO#
. During this encounter,
my client and other witnesses on scene claim Officer
was extremely rude, used
racial undertones during their encounter, was biased and displayed conduct unbecoming of
an Austin Police Officer. I advised my client once I received the required bodycam footage
through discovery and substantiated his claims I would follow up with Internal Affairs. I
received the discovery today and the Officer admits in the report he violated APD policy
by not turning on his required BWC. Based upon my clients allegations against this officer,
it is highly plausible the officer intentionally fail to turn on his camera as required in order
to destroy evidence of his unbecoming conduct during the call.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
