NOTICE OF COMPLAINT
October 28, 2022
ICMS #: 2022-0988
On October 27, 2022, the OPO received an online complaint.
The complainant alleges: An update on my previous complaints from
, , I
contacted your office to convey my concerns regarding a deceased person and the
investigation from
, Case #
the Detective investigating the
case was Detective
who has now been promoted to
I spoke to Detective/ Lieutenant
on
with new and over
whelming information and evidence which he ignored and has chosen to stick to the report
he wrote in
.
Our family knows" for a fact that the witnesses provided fabricated
stories and seems that they were coached on what to say which are also contradicting and
do not make sense. Detective
allowed the only two witnesses he spoke to possibly
get away with murder. He did not contact any other family such as parents or his biological
children and he did not further investigate the statements the two witnesses gave regarding
the deceased person found in the former wife's and the former stepdaughters apartment the
deceased once shared with them as he had moved back to his hometown of
Texas and made the trip to Austin to gather the rest of his belongings and was expected to
return home on the day he died. When I contacted Detective/ Lieutenant
on
I mentioned that shortly after
death our daughter
contacted him to inform him that she was the biological daughter and that she was trying
to tell him that she was supposed to go with her father on this trip as she had a bad feeling
that something bad would happen to him and was asking for copies of his investigation
report and pictures Detective
would not release a copy to the family for 9 years and
blocked the family from obtaining copies. After he was promoted, our daughter was finally
able to obtain copies in
I have made every attempt to contact every law
Enforcment agency without success. Your office is the last attempt I have made and since
filing formal complainants, I received a call from a Lieutenant
who called me on
at
and informed me he was assigned to investigate a "Cold
Case" from
I am not sure who assigned him but after we spoke on the phone
regarding the death of my former husband, I am the first wife and the only wife who had
his children of the three wives Mr.
was married to. Lieutenant
told
me that he would be contacting me through email or call me since our phone call he had

not contacted me not even to ask for names addresses or phone numbers of persons having
knowledge of this matter. About a month later I contacted Lieutenant to see how the
investigation was coming along and if he needed any information to help with the
investigation my call went to voice message, I believe i called him twice and had a third
Police officer return my calls. I was not able to hear his name or his phone number as I was
at a doctor's appointment on that day. It seems to me that the third officer did not have
knowledge on what had already been discussed and reason my complaints were being
investigated against Detective/Lieutenant
investigation of my former husband from
.
It is very clear that the third officer was used to try and brush me off, I mentioned
that the only two witnesses who resided where the dead body was found were never
questioned again and were not forced to take a polygraph and that the following day after
his death the former stepdaughter told my eldest daughter that has resided in Austin Texas
for over 20 years and was not immediately contacted until the body was removed from the
apartment and admitted to my daughter also Mr.
biological daughter that
she had put on the grey shorts on her father he was laying on the floor naked and did not
call 911 for assistance until later that evening, basically the former stepsister tampered with
the crime scene. The third officer then suggested I call the records department and request
the photos or information missing, my youngest requested them again and received a
response that the "specific" photo did not exist, which confirms my suspicion that the body
was found on the floor as shown on the photos and that he was not found dead lying face
down as stated on Detective
report which are full of discrepancies. Open Records
Department sent an email confirming the information was requested on
I will no longer speak to police officers at the Austin Police department as they are only
helping Detective/ Lieutenant
cover up his mistakes and I need further assistance
from the Department of Justice to investigate "Murder Cover Up".
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
