Non-peak Hours Concrete Installation Permits

In the City of Austin, installing concrete within 600 feet of a residence, church, hospital, hotel, or motel is not allowed between 7:00 p.m. and 6:00 a.m. unless a permit is issued as authorized under Section 9-2-21 (Permit for Concrete Installation During Non-Peak Hour Periods). Concrete installation beyond 600 feet of a residence, church, hospital, hotel, or motel may take place and be audible to an adjacent business or residence from 7:00 a.m. – 10:30 p.m.

The Development Services Department (DSD) issues permits to install concrete between 7:00 p.m. and 6:00 a.m. only if:  

  • A determination is made that the delivery, finishing, placement, or pouring of concrete during non-peak hour periods is in the interest of public health, safety, and welfare or is justified by urgent necessity; and  
  • The property is located in the downtown area within the Downtown Density Bonus Area and zoned Central Business District (CBD) or Public (P). Please contact us if you have questions about the area.
     
How to Apply

 

step 1   Determine the Type of Permit That Is Needed 

First, you must determine which permit you need for your concrete pour project from these types:

Type 1 Non-Peak Hour Permit: 

  • Permitted hours: 7:00 p.m. to 12:00 a.m.
  • Maximum sound level: 83 decibels unless further restricted by a sound management plan.

Type 2 Non-Peak Hour Permit:

  • Permitted hours: Midnight to 6:00 a.m.
  • Maximum sound level: 78 decibels unless further restricted by a sound management plan.

Type 3 Non-Peak Hour Permit: 

  • Permitted hours: 7:00 p.m. to 6:00 a.m. 
  • Maximum sound level: Unlimited. 
  • May only be issued if:
    • a special circumstance exists that requires a continuous pour, such as a mat slab or similar foundation pour that would be inconsistent with a Type 1 or 2 permit; and
    • the permit application includes a letter from a professional engineer of record for the project confirming that the late-night pour must be continuous and cannot reasonably be divided into multiple shorter pours. 
       

step 2   Prepare Permit Application Requirements

An application is required for every scheduled concrete pour, and the permit is valid for one pour within a defined 72-hour period. Your completed application must include the following:

  • Sound and Light Management Plan
  • Copy of required signage and list of affected parties who will receive notification
  • Name and phone number of a contact who will be on-site throughout the installation

 

step 3   Complete Permit Application

step 4   Email Permit Application

Email the application and the additional documents to Bryan.Walker@austintexas.gov

The permit fee can be paid online, and after the application is approved, the active permit can be emailed to you.  

 

step 5   Right of Way Permit (Optional)

A Right-of-Way (ROW) Permit from the City of Austin Transportation Department is required for work in or use of the public ROW. ROW applications must include requested barricading hours and address traffic flow issues. A permit/traffic control plan must be at the work site and available to present to inspectors or other City officials upon request.

Complaints, Decibel Limits, and Violations

Complaints

If the City of Austin receives a report of an alleged violation of decibel limits from a neighbor adjacent to a work site, the Development Services Department (DSD) will:

  • Deploy sound monitoring equipment for a subsequent concrete pour
  • Work with the contractor to address and mitigate neighbor noise concerns if no violation is found. Permit eligibility continues.
