The Austin Police Department (APD) continues to investigate the officer-involved shooting that occurred on November 11, 2023, at 9308 Bernoulli Drive.
APD understands the importance of building trust within our community and will continue working diligently to develop a strong and trusting relationship. As per our policy, we share information about a critical incident within ten business days of its occurrence. APD worked with the Office of Police Oversight and the City of Austin to release this information today. The press release includes links to the relevant audio and video from the ongoing investigation. The Travis-County District Attorney's Office reviewed the audio and video materials identified for public release. The details provided today are preliminary, as we are very early in the investigation.
Two SWAT Officers and one SWAT Sergeant discharged their Department-approved firearms. The first SWAT Officer who discharged his Department-approved firearm is Officer Jared Carruth and he has ten years and eleven months of service with the Department. The second officer who discharged his Department-approved firearm is Officer Kevin Olejar and he has eight years and eleven months of service with the Department. The SWAT Sergeant who discharged his Department-approved firearm is Sergeant Kevin DeLaRue and he has 16 years and seven months of service with the Austin Police Department. Per APD protocol, all three officers have been placed on administrative leave.
APD will conduct two concurrent investigations into this incident: a criminal investigation conducted by the APD Special Investigations Unit in conjunction with the Travis County District Attorney's Office and an administrative investigation conducted by the APD Internal Affairs Unit, with oversight from the Office of Police Oversight.
Transparency and accountability are key elements needed to serve and build relationships within the Austin community. Below is the chain of events related to this critical incident that will help you understand what took place.
At 2:49 a.m., Austin 9-1-1 Communications received a call requesting assistance at 9308 Bernoulli Drive, where the caller was screaming for “help”. The caller, who was later identified as an apparent victim of the suspect, provided more details and said someone was stabbing her.
At approximately 2:57 a.m., initial responding patrol officers, who were wearing Austin Police uniforms, arrived near the location in response to the 9-1-1 call which was titled "Shoot/Stab Hotshot." The officers began to gather additional information, including the suspect's location. Officers were also notified that two other people were injured inside the residence with the suspect. The suspect was later identified as Mr. Ahmed Mohamed Nassar.
Before the officers arrived at the provided address, the 9-1-1 caller and victim was able to escape from Mr. Ahmed Nassar and the residence. The victim was located by officers and Austin-Travis County EMS in the neighborhood. She said the suspect (Mr. Ahmed Nassar) still had the knife. At 3:03 a.m. she was then transported by Travis-County EMS to a local hospital for the injuries she sustained.
At approximately 3:00 a.m. based on the information provided to the patrol officers, they made an emergency forced entry into the residence, to rescue the two injured victims. Before the officers made entry, they announced and identified themselves as Austin Police Officers. At approximately 3:01 a.m. as the officers entered, they were fired upon by Mr. Ahmed Nassar. The officers backed out of the residence but did not return fire.
Because Mr. Ahmed Nassar was armed and barricaded inside a residence with two hostages, a SWAT callout was initiated at 3:06 a.m. At approximately 4:11 a.m. SWAT Officers made an emergency entry to rescue the victims. Once the SWAT Officers were inside of the residence in a back bedroom, Mr. Ahmed Nassar fired his gun at the SWAT Officers, which caused SWAT Officers Carruth and Olejar, along with Sergeant DeLaRue, to return fire.
At approximately 4:15 a.m. during the exchange of gunfire, information was provided over the police radio that two officers were shot. Officers that were on the scene, along with Austin-Travis County EMS Tactical Medics, courageously and immediately moved the injured officers to safety and began to render medical aid.
The two officers were transported to a local hospital by Austin-Travis County EMS. Despite the tremendous efforts of our officers, Austin Fire Department firefighters, Austin-Travis County EMS medics, and the medical staff at the local hospital, APD Officer Jorge “George” Pastore succumbed to his injuries and was pronounced deceased.
At approximately, 4:37 a.m. Officer Pastore arrived at the hospital and was pronounced deceased at 4:56 a.m. At approximately 4:39 a.m. the second officer arrived at the local hospital and was admitted to the hospital for the injuries he sustained during the incident, where he was treated and later released.
Two apparent victims of Mr. Ahmed Nassar were located inside the residence with fatal injuries and were pronounced deceased on the scene. The two victims were later identified as Ms. Eyman Elnemrnassar and Mr. Riad Nassar. SWAT Officers provided medical aid to Mr. Ahmed Nassar on the scene. Mr. Ahmed Nassar succumbed to his injuries and was pronounced deceased on the scene.
This incident was captured on officers’ body-worn cameras. Body-worn camera videos do not always capture everything the officer or witnesses saw or experienced during the incident; however, the footage helps us understand what occurred.
In compliance with state law that prohibits the release of certain information and to maintain the integrity of the investigation, the materials have been redacted. Portions of the videos released were taken in a private space. Pursuant to Sections 1701.651 and 1701.661(f) of the Texas Occupations space Code, these portions of the videos are not being released. The materials include comprehensive footage of the officers' actions and contain graphic content and language. Viewer discretion is advised.
