On March 7, 2023, the OPO received a phone complaint.
The complainant alleges: APD officers in vehicles
and
came to his residence
and he is not sure why. The complainant's neighbor called him and sent him a picture of
two officers touching his bike illegally because he did not give them consent to search. The
complainant's bike is legally registered under his name. The complainant's neighbor asked
the officers why they were touching the bike and the officers told him they were checking
to see if the bike was stolen, which is not true because his bike has never been reported
stolen and no one has called it in stolen. By law the search was illegal and a lawsuit because
he never gave them permission to touch his bike because he was not even at home. The
officers were infringing on his rights. There was no secondary or first offense crime
established. By law in the state of Texas they cannot touch his bike without his permission.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
