COMPLAINT

Complaint:
complainant, filed a complaint with the Office of Police Oversight
stating the following:
"I am filing a complaint on behalf of my daughter who is a minor. She works as a lifeguard
for the city of austin. on
she was working as a park monitor at
Four squad cars arrived. and shortly after, Alex Jones from InfoWars arrived. He screamed
at the lifeguards some of whom are minors. He was not wearing a mask. He screamed in
some of their faces at close range. He did not maintain his 6 feet of distance. The APD
officers did not intervene in any way. Some APD officers were not wearing masks. The
APD officers did not attempt to educate Alex or ask him to put on a mask or give him a
citation. They did not make him keep his 6 foot social distance. They did not protect my
daughter from verbal abuse nor from the danger of exposure to COVID. The police officers
should always be masked in public. They should protect children from adults threatening
them. There were 6 other lifeguards present as witnesses. I do not have their permission SO
I am not naming them. We do not know the name of the officers but you will see one
unmasked officer in the video."
This notice of formal complaint is a request for Internal Affairs to initiate an investigation in
order to determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
Recommended Administrative Policies to Review (to include but not limited to):
110.4.4 INSUBORDINATION
Employees will not be insubordinate. The willful disobedience of, or deliberate refusal to obey
any lawful order of a supervisor is insubordination. Defying the authority of any supervisor by
obvious disrespect, arrogant or disrespectful conduct, ridicule, or challenge to orders issued is
considered insubordination whether done in or out of the supervisor's presence.
Recommended Classification: The OPO is permitted to make a preliminary recommendation
on the classification of administrative cases.
The OPO recommends that this allegation receive a B classification.
The City of Austin is committed to compliance with the American Disabilities Act.
