On April 22, 2022, the OPO received an online complaint.
The complainant alleges: PLEASE NOTE THE FOLLOWING:
(18yr/Senior), the son of Austin Police Department (APD) Detective
snuck up on our son from behind during wrestling practice
(
and choked him out until he lost consciousness. When our son went limp his attacker dropped him
on his face and our son suffered multiple bone fractures in his jaw and had his mouth wired shut
- Officer
of the
Police
Department called us and tried to dissuade us from filing a police report he said that it would
take 6-8 weeks and no charges would be filed as Travis County is too liberal o Please note that
Officer
is a retired 27 year veteran of the Austin Police Department (APD)
and knows our attackers son - Detective
and Officer

while at the Austin Police Department (APD).

Police Department Chief
that when the recorder stopped recording
and my sons statement and was walking out, Officer
threatened our son SO

replaced Officer

is a retired 22
year veteran of the Austin Police Department (APD) Chief
served as a police officer,
detective, sergeant, lieutenant, and division commander prior to his retirement. As a commander
at APD, he served in a leadership role for hundreds of officers in numerous units including Patrol,
Internal Affairs, Special Operations, Police Technology, Risk Management, Training, and
Recruiting.
Chief
sent us an email with the following update:
o "I am writing to provide you with an update regarding the criminal investigation involving your
son as a victim. After a very thorough investigation, the facts of this case and the events leading
up to it were presented to a Travis County Assistant County Attorney (ACA) for review. After a
review of the facts, the County Attorney's office has advised they will not accept the case for
prosecution. In other words, the ACA has determined that the facts of the case, and the totality of
the circumstances surrounding it, are not strong enough to support a successful prosecution. Due
to the ruling by the ACA, the criminal investigation is being closed exceptionally - prosecution
declined."
- We received the REQUESTED CITATION
from the Travis County District Clerk's Office (459th) and immediately sent it to Direct
Results Legal Service (DRLS) to serve

at home with no answer, they left their contact data. Later that day APD Detective
called DRLS, said he is w/ the APD and threatened to arrest (trespassing) the DRLS
agent person trying to serve his son our civil citation

called DRLS and said that said they are ready to cooperate and he will let me
know when to return

another email from Chief

- one of the accusers is who attacked our son) o "I am writing to let you know
that during the course of the investigation regarding your son,
several students have alleged
they have been physically assaulted by
Three of those students (or parents) opted to pursue
criminal charges. The investigating officers gathered the facts and presented them to a Travis
County Magistrate who determined there was probable cause and issued three arrest warrants for

Department (APD) o The FATHER of the Sophomore that is accusing our son of an assault with
injury is retired Austin Police Department (APD) Lieutenant
who worked for the
department for >23 years and worked in the Austin Regional Intelligence Center (ARIC) o The
MOTHER of the Sophomore that is accusing our son of an assault with injury is also an Officer
with the Austin Police Department (APD) o The FATHER of the Senior (18yr old) that attacked
our son, along with his Freshman brother, is Austin Police Department (APD) Detective
To date, we have learned that the Travis County Assistant County Attorney (ACA) has
no record of the Lake Travis ISD Police Department ever submitting anything regarding the attack
on our son. We believe that there is a significant connection between the investigating authorities
and the parents of these alleged victims. The one thing that connects them all is their association
with the Austin Police Department (APD). All of them worked for or are currently working for the
Austin Police Department (APD). We believe that they coordinated their efforts and leveraged
both their knowledge of the legal system as well as their understanding of the differences between
the Travis County District Attorney office, the Travis County Assistant County Attorney (ACA)
office and the Travis County Magistrate office to help navigate or steer this investigation in a way
that would intimidate us from pursuing criminal charges or filing our Civil Petition with the Travis
County District Court. For some reason, these very experienced law enforcement officers decided
to (allegedly) submit their investigation into the attack on our son to the Travis County Assistant

County Attorney (ACA) rather than the Travis County District Attorney which is who should have
seen it. Then they decided to submit the investigation that they ran against our son to the Travis
County Magistrate instead of the Travis County Assistant County Attorney (ACA) as they did our
sons report. We believe that the
and the
Police Department have an agenda to attack the REAL victim here and they weaponized the Austin
Police Department (APD) to silence us and make us go away.
This notice of complaint is a request for Internal Affairs to initiate an investigation to determine
if the employee conduct is within compliance of APD policy, Civil Service Rules, and Municipal
Civil Service Rules.
