On August 8, 2022, the OPO received a phone complaint.
The complainant alleges: The complainant doesn't know the date of the incidents or when
she spoke with police, only that it might have been in
last year. The complainant
alleges: She was sexually assaulted by her neighbor. She made a police report and was later
contacted to come in for an interview. She was homeless at the time and was having car
trouble. She told them she couldn't come in and they said she must come in at that time.
She was interviewed by a male detective with two women present - one who was supposed
to support her and provide victim services information (but did neither) and one who was
a trainee. The complainant explained that during the assault she said no multiple times, was
backing away, and was hysterical. The detective asked her if when she said "no" to the
attacker that he might have taken it as an answer to something else he said to her. This was
completely inappropriate. Neither of the women spoke up for her when he said this to her.
They just sat there while a man badgered her and said, "This didn't happen the way you
think." They asked her if she wanted to get the guy to confess. He had already apologized
to her. She thinks she could have gotten a confession out of him if APD hadn't already
brought him in for an interview, where he said everything was consensual. The complainant
wants to complain against everyone who made contact with her. The complainant thinks
that her being homeless at the time, with a history of mental illness, and with an
acquaintance rape factored into officers not taking her seriously. The complainant wonders
how many complaints APD needs to realize that something is wrong with the way they're
operating as a department.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
