MEMORANDUM
Austin Police Department
Region IV Patrol
TO:
Joshua Marquez, Sergeant
FROM:
Michael Eveleth, Commander
DATE:
July 22, 2020
SUBJECT: Written Reprimand IA Case 2020-0618
This memorandum is in reference to an incident which occurred on, or around, November/December
2019, and your conduct at that time. Specifically I am referring to your involvement in the streaming
of (comedy) audio/video media from the Internet for non-business related purposes without approval
of a supervisor. Specifically, a comedy video that could be viewed as offensive.
Your actions violated the following APD General Orders:
APD G.O. 900.1 PURPOSE AND SCOPE, which states, "It is the policy of the Austin Police
Department that employees conduct themselves at all times in a manner that reflects the ethical
standards consistent with APD written directives." And further states, "This order is intended to
guide employees in conducting themselves and their affairs, both on-duty and off-duty, in a
manner that reflects the professionalism required of Department personnel."
APD G.O. 1000.3.1 PROHIBITED USES OF DEPARTMENT TECHNOLOGY, which states,
"Prohibited uses of any Department Technology include, but are not limited to, the following: (i)
Streaming of audio/vide media from the internet for non-business related purposes without approval
of a supervisor."
You are hereby reminded that compliance with the Department's rules and regulations are a
condition of your continued employment as a police officer. Failure to comply with this policy in the
future may result in more severe disciplinary action against you, up to, and including an indefinite
suspension. Please be advised that but for the fact that this matter is outside the 180-day period for a
suspension under Texas Local Government Code Chapter 143.052, the Chief of Police would have
considered much harsher discipline up to and including the possibility of an indefinite suspension.
