On March 29, 2023, the OPO received an online complaint.
The complainant alleges: My brother was shot and killed by APD officers after he called
911 asking for help. He thought people were following him, surrounded him and pointing
guns at him. He was paranoid and called for the police to come. It was clearly a mental
health case and the officers knew he called for help, as you can hear on their body cam
videos. They did not announce who they were and that they were responding to his 911
call. They did not try to deescalate but rather told him to put his hands in the air. Who tells
a paranoid person calling for help to put their hands in the air? That only makes him more
paranoid. Now his paranoid fears are his reality.
To say they used excessive force is an understatement. I think all 5 of them emptied their
rounds on him. His truck was shot up, windows blown out. We couldn't even view his
body it was SO blown up.
It's been
months and we still haven't heard anything about the investigation, no
toxicology report, no autopsy report, no update about the police officers involved. Do they
have other cases of excessive force? We have not been given any information. My sister-
in-law is left raising the two children they fostered and adopted together and another baby
they were trying to adopt. My brother was a "back the blue" kind of guy. I really don't
believe he fired shots at the officers nor do I see that on their body cam videos, but that's
what they told the media and our family. We want answers.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
