On September 20, 2022, the OPO received a phone complaint.
The complainant alleges: He called 311 to report a stolen vehicle. He had to mail an
unauthorized use of a motor vehicle affidavit and when he got it back it was submitted to
APD. It took almost a month to get a response back from APD. Detective
told
him he had an incorrect UUMV, SO it was refiled and corrected. Then the complainant
was told this is not a case APD is willing to take. The detective is not properly
investigating the case and misrepresenting facts to the assistant DA. Detective
told
him that the assistant DA is not willing to take the case. The complainant contacted the
assistant DA who told him that the case was never presented to him. Detective
then
presented the case as, "I am presenting this case, but you don't want to take this case."
The assistant DA did not take the case because it was poorly presented by Detective
The complainant is trying to work with the assistant DA because the DA's office has
advised him that this is an offense they are interested in pursuing. His complaint is that
Detective
is not properly investigating the case and not giving his case due
diligence.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
