On June 28, 2022, the OPO received a phone complaint.
The complainant alleges: He was arrested on

drinking at the pool
and when got back from the pool his ex got upset and wanted
to leave. He advised her it was not a good idea because she had been drinking and he did
not want anything to happen to her or the kids. The complainant alleges she became erratic,
scratched him on his, and began cursing the older son. Complainant called 911. When the
police arrived one of the officers talked to his ex and the other officer talked to him. He
told the officer what had happened. When he showed the officer his chest the officer asked
him what he did to cause her to scratch him. The complainant was offended. At that point,
he requested a supervisor and asked the officer to wait outside until the supervisor arrived.
The officer responded no. The officer told him he was being arrested. He asked him what
he did wrong. The officer became aggressive, grabbed him, and threw him to the ground.
The complainant never resisted the arrest, but the officer continued to use aggressive force.
Before all that happened, the officer stated his partner did not think his ex was drunk and
she was not showing any signs of being drunk, even though she admitted to having over 5
drinks. The officer let his ex drive away with his kids even though she had admitted to
drinking over 5 drinks.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
