On May 23, 2022, the OPO received a phone and email complaint.
The complainant alleges: She called 311 to make a non-emergency complaint regarding
an incident that happened. On
she sent an e-mail giving a full description of
what happened on
and never heard anything back. On
she sent
an e-mail updating her e-mail address and the detective e-mailed her back telling her he
had updated her e-mail address. After that e-mail, she never heard back from him SO she e-
mailed the detective again on
asking for an update and she received a response the
same day from detective
who told her "He did not think she needed a response and
the asked her "how can I help you?" Detective
told her he was going to follow up
with her witnesses but later he admitted he never contacted the witnesses. Her husband e-
mailed the detective but received an automatic reply that he was out for 2 weeks. The next
time her husband called he did reach detective
who told him that she had emailed
too much information, the information was all over the place. During that conversation,
detective
labeled her and diagnosed her as mentally ill and paranoid, and said he
had shelved the case. During that same conversation with her husband, Detective
also compared her to a previous incident where the person was in a mentally ill state. Also,
when she reviewed her case, she noticed Detective
had written the incorrect date
and their first e-mail exchange was

I have forwarded along a case that has been mishandled
terribly in my opinion by the Austin Police Department and Mr.

only did he not make one phone call or speak to one person, he decided to warn me by a
preliminary diagnosis of mental illness that my wife may suffer from because of all the
"abundance of emails" that
was merely COPIED on, not sent to him. to illustrate

completely different illustrations of an event that happened this Past
I just wanted to have it all straight before it is going to apparently move to another detective
by your doing or it will be initiated by me as you're on leave and you have already explained
to me that you had "shelved the case" and "suspended" it because of "too much information

my wife had sent that you didn't know what to do with it". So, I asked you to just put all
her mountains of information on the back burner and just asked you if you had even
initiated ANY semblance of an investigation as to it's validity by making phone calls and
asking only TWO people questions about the
first incident.
You said, after
months lets remember, that you would contact

of lies, cover ups, etc. yet you still had failed to speak live to EITHER ONE of the TWO
persons we asked you to???
So, the incident happened on

Clearly, the dates of the offense are
incorrect as well as when we first contacted you are incorrect.
Regardless of these inaccurate dates, you HAD at the very least,
MONTHS to call and
get a hold of the two main parties involved in this date of offense of a suspicious person
case given to you. Yet, you failed to speak to EITHER ONE of these people to see if all
the other mountains of evidence and claims that
sent you even MAY HAVE carried
some actual facts????
Let me ask you, before you "shelved this case" what exactly or whom exactly did you
EVER SPEAK to??? What did you even do with those first
months?? It seems to me
you HADN'T spoken to ONE person before you "shelved" the case citing that there was
"too much information" and that my wife may be "suffering from mental illness and you
do not take this lightly???"
Do you take your detective work "lightly" as well? It seems to me that you hadn't spoken
to even one person or even the two people that I had again asked you too after the first
where it seems you hadn't done a thing?? Please correct me if I am
wrong. I say this Because if you had even bother to SPEAK even ONCE to these two
individuals and actually questioned them both about the events on
that
we have explained in great detail, don't you think that maybe just maybe that may lend
credence to the validity of all the other overwhelming information that you had received
from
that basically made you actually diagnose her with some kind of mental illness
maybe, and that you didn't know what to do with the abundance of information that you
said "didn't even fall under your jurisdiction"? That would have been fine if all ove the
information or most of it you couldn't use or do anything about!!

Yet, you failed to do anything about ANY of the information! You failed to even speak to
the first two people we had asked you to now going on months now as we have an email
TO YOU on

other email account.
So, basically after
months, you never spoke to even the two primary people, which
would have lead you to wherever those answers from those two people would have lead
you. It looks to me that after
months, you literally had done nothing!
You had written my wife a couple emails, you spoke to me on the phone only once when I
called you and you then informed me that after months of you not speaking to a single
soul, you had "shelved or suspended the case" and that you were concerned about my wife's
mental state??
Those are the exact facts as I see them based on emails and our one conversation. If I am
incorrect, PLEASE let me know, as well as who or what you actually did do other than
basically read emails my wife had emailed the
incident of suspicious
person, then when you TOLD Me SHE HAD EMAILED YOU MULTIPLE TIMES WITH
TONS OF IRRELEVANT AND INFORMATION" Which wasn't exactly correct either.
She Had just explained to me that she ONLY CC ed or copied you on emails to

to perhaps show you how she would inaccurately respond to us about basically
anything!! She was showing you her character!! She was NEVER asking you to investigate
our living sanitary situation as you made it seem to me!! She had merely copied you one
emails to our complex to lend validity to our stating that they are not very adept at getting
back to us nor with any accurate information!! That was it!!
Upon which you "shelved" or "suspended" the case without ever speaking to one person
on our behalf or request?? You didn't even tell us you had suspended the case! Now, I am
curious to if you had accomplished even one thing in regards to the intial incident that took
place in
?? Or better yet, Please inform me of absolutely ANYTHING you may
have done regarding this case??? Except diagnosing my wife with perhaps a mental illness,
which I firmly believe that diagnosing ANYONE with any sort of ANY MEDICAL
diagnosis does NOT fall under your jurisdiction!! Also, I am pretty sure you are not really
qualified to do that either unless you have a MD by your name that I am not aware of??

This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
