On April 7, 2022, the OPO received a phone complaint.
The complainant alleges: He got pulled over by two APD officers. As he was smoking a
cigarette, one of the officers came over and told him to put his cigarette out. He asked the
officer if that was how he did a pull over. As the officer began to argue, he told the officer
all he was asking is that he treat him like a normal person and not a bad person. The officer
told him there was a warrant out for him. The other police officer went to the passenger
side of the car and his cousin opened the door. Complainant asked his cousin why he
opened the door because he did not feel safe right now. The officer pulled his cousin out
of the car and started to search him. The other officer told him he needed to get out of the
car. He got out of the car and faced the car with both hands behind his back. The officer
placed his hand on his neck pushing his head down to his car. He stood up and asked the
officer why he was doing that if he was letting him make the arrest. The other officer
came over and started kicking his leg with force. The other officer tripped and fell as he
tried to take him down. The complainant fell on top of the officer and the other officer fell
on top of him. He asked the officers to let him up and both officers began tasing him. They
were tasing him a lot, even on his bare skin, as he was yelling and screaming for them to
call a sergeant. They picked him up very awkwardly, hurting a previous shoulder injury
as he was telling them to let him go. He pleaded for a good four minutes. He started to
cry and say he did not resist, and they took advantage of him. They took him to
the
ambulance and then to the hospital for x-rays. He asked one of the officers if he thought
he used excessive force and the officer replied, "maybe a little bit". He had taser marks all
over him and bruised ribs. Another officer,
spoke to him and told him he needed
to file a complaint because he has seen those officers do that a lot.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
