On March 30, 2022, the OPO received a phone complaint.
The complainant alleges: He and his girlfriend had been drinking inside their home and began
arguing. APD came and knocked on their door and told them they had a complaint from a neighbor.
He and his girlfriend spoke to the officers and told them everything was ok, and they did not need
their services SO the officers left. The second time a neighbor called and told officers there was
someone on the balcony about to jump, but there wasn't. The police came and knocked on the door
with a flashlight. The complainant did not open the door but told the officers they did not need
their help. The officers said they were coming in anyway. The complainant told the officers they
could not come in without a warrant, SO the officers kicked down the door with guns drawn. The
complainant alleges he has a gun and did not want to be another statistic, he feared for his life, SO
he ran, jumped off the balcony and broke his leg. The officers handcuffed him and his girlfriend.
The officers searched the house and found his gun, which was a legal weapon, and took it apart.
There was no case against them and no one was arrested that night. The officers did not have
probable cause to enter his home, SO he feels his 4th amendment right was violated.
This notice of complaint is a request for Internal Affairs to initiate an investigation to determine
if the employee conduct is within compliance of APD policy, Civil Service Rules, and Municipal
Civil Service Rules.
