Complaint: Complainant, Mr.
:
The police were called because my
neighbors and I got into an altercation. I was put in handcuffs and my neighbors got to go inside
their apartment. Police searched my car and my car had nothing to do with it. What did my car
have to do with the situation? Why wasn't my neighbors car searched as well? they were part of
the situation. My Michael Kors watch is missing after the police searched my car, I think the police
has it. They violated my rights.
This notice of formal complaint is a request for Internal Affairs to initiate an investigation in
order to determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
Recommended Administrative Policies to Review (to include but not limited to):
306.3.1 SEARCH PROTOCOL
(a) Officers will conduct person searches with dignity and courtesy.
(b) Officers will conduct property searches in a manner that returns the condition of the property
to its pre-search status as nearly as reasonably practicable.
Recommended Classification: The OPO is permitted to make a preliminary recommendation
on the classification of administrative cases.
The OPO recommends that this allegation receive an A classification.
