submitted a complaint to the Office of Police Oversight alleging
the following:
The complainant called the police.
arrived and the complainant said
the sergeant gave him attitude. There were two other individuals who came to watch what
was happening and the officers did not tell them to go away. The sergeant referred to the
complainant as an aggressor. The complainant disagreed and also asked both the sergeant
and two other officers to go to the hospital because the complainant had a knot on the side
of his face. The sergeant then said that due to coronavirus he could not take him to the
hospital. The police took him to jail and said he would be there for a couple hours but was
there until the end of the next day. The complainant called dispatch to ask for another
person in charge to come out and the sergeant told dispatch to not send anyone else and
turned away EMS. After the situation, the complainant said the documentation didn't
reflect what really happened. The complainant has an issue with the fact that the sergeant
did not let him go to the hospital and that the complainant was blamed for the situation
when he was assaulted.
This notice of formal complaint is a request for Internal Affairs to initiate an investigation in
order to determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
Recommended Administrative Policies to Review (to include but not limited to):
301.1 PURPOSE AND SCOPE
All persons deserve protection by fair and impartial law enforcement and should be able to expect
similar police response to their behavior wherever it occurs. Employees will serve the public
through direction, counseling, assistance, and protection of life and property. Employees will be
held accountable for the manner in which they exercise the authority of their office or position.
Employees will respect the rights of individuals and perform their services with honesty, sincerity,
courage, and sound judgment.
301.2 IMPARTIAL ATTITUDE AND COURTESY
Employees are expected to act professionally, treat all persons fairly and equally, and perform all
duties impartially, objectively, and equitably without regard to personal feelings, animosities,
friendships, financial status, sex, creed, color, race, religion, age, political beliefs, sexual
orientation, gender identity or gender expression or social or ethnic background.
Recommended Classification: The OPO is permitted to make a preliminary recommendation
on the classification of administrative cases.
The OPO recommends that this allegation receive a B classification.
The City of Austin is committed to compliance with the American Disabilities Act.
