In order to participate in the formal Impartial Hearing Examiner (IHE) process you must:
Be an Austin Water customer
Have access to an email account where you can receive documents throughout the process.
Austin Water and the City of Austin have attempted to make participation in the IHE process simplistic. Even so, there are certain requirements that all participants must meet in order to provide the best opportunity for a fair outcome for all stakeholders.

Standard Templates for Document Filing
Austin Water and the City of Austin are attempting to make the IHE process as accessible as possible by developing standard document templates that anyone can use throughout the IHE process. It is not a requirement to use these templates. They are provided only for convenience and to help simplify participation in the IHE process. If you chose not to use a template, be sure to put your name and the title of your document on the first page then sign and date the last page. Also, read the procedural rules to determine if specific information is needed for certain types of filings. If you would like to use a template download a copy of any of the templates below, fill in the blanks, and file the document as required by the procedural rules.

Templates are in Microsoft Word format and can be altered by any participant. If you choose to alter the form itself, make sure you provide the required information as outlined in the procedural rules. Otherwise, your filing may not be considered by the Impartial Hearing Examiner. There may be other documents that you wish to file for which a template has not been created. You may create your own filing form just be sure to provide the minimum document requirements noted below as well as any information that is required in the procedural rules.
How to File Your Documents
All documents can be filed either electronically or in person. More details regarding document acceptance dates will be posted in the coming months.
To file your document electronically, email your document to IHE 2017.
To file your document in person, visit the City of Austin - Office of the City Clerk located on the first floor of Austin City Hall, 301 W. 2nd Street, and hand deliver your document to the clerk.
Documents that are mailed to the City Clerk’s office or to Austin Water will not be accepted and will be returned.
Note: You will also need to provide the other parties with a copy of your filed documents as required by the procedural rules. There will be a list of parties’ names and email addresses posted on the Office of the City Clerk's rate review website and it will be regularly updated for any changes.
Minimum Document Requirements for Filing
Any document that is filed in the IHE process will be reviewed to ensure that it includes:
The name of the party filing the document
The signature of the party (or the representative of the party) filing the document
The title of the document
An email address at which the party can be reached
All documents that include the minimum requirements will be accepted and placed into the official record for the process. Any documents that do not include the minimum requirements will be returned to the submitter to complete any missing information.
Honest and Fair Representation
While it is not required to file the documents under oath (swearing that all of the information is correct to the best of your knowledge), we request and expect every participant to be respectful of the process and fair to all its participants. Please file all documents as if you were under oath.
Record of Filed Documents Available Online
The Office of the City Clerk will maintain a website that lists all documents filed during the IHE process. All filed documents will become part of the public record of this process. The documents will be visible to anyone and available for download whether or not they are participating in the process.
Follow these specific steps to participate in the IHE Process:
If after reading the procedural rules, you decide that you wish to participate file a Motion to Intervene. Your motion to intervene must state that you are allowed to participate and identify the issues you would like to address in the process.
Once you have filed your Motion to Intervene, you may begin participating in the IHE process including filing your initial presentation on the issues and requests for information.
After the Impartial Hearing Examiner grants your Motion to Intervene, you should regularly check the Office of the City Clerk’s website to see what new filings have been made. Neither the City of Austin nor Austin Water is responsible for informing you when new filings are made.
